Welcome to AInalyz. Please read these Terms of Service ("Terms") carefully before using the AInalyz website and SaaS platform (the "Service") operated by AInalyz ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

AInalyz is a data analysis platform that utilizes a programmable grid, predefined Templates, and data processing engines to transform raw data into actionable insights. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

2. User Accounts

• Responsibility: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• Accuracy: You must provide accurate and complete information when creating an account.
• Termination: We reserve the right to suspend or terminate your account at our sole discretion, without prior notice or liability, for any reason, including a breach of these Terms.

3. User Data and Content

• Ownership: You retain all rights and ownership to the raw data and datasets you upload to the Service ("User Data"). AInalyz claims no ownership over your User Data.
• User Warranty: By uploading data, you represent and warrant that you own the data or have the necessary legal rights, licenses, and permissions to upload and process it. You agree not to upload classified, stolen, or highly sensitive personal information (such as PHI under HIPAA) for which you lack authorization.
• License to Process: You grant us a temporary, limited license to process, compute, and render your User Data solely for the purpose of providing the Service to you.

4. Acceptable Use and Restrictions

You agree not to misuse the Service. Specifically, you shall not:

• Reverse engineer, decompile, or disassemble any aspect of the AInalyz platform, including the programmable grid and Templates.
• Use the Service to process data for any illegal or unauthorized purpose.
• Attempt to bypass rate limits or artificially overload our backend data processing infrastructure (e.g., executing abusive, continuous, or excessively massive queries intended to disrupt service).
• Scrape, copy, or redistribute the proprietary Templates provided within AInalyz.

5. Intellectual Property

The Service and its original content (excluding User Data), features, functionality, software architecture, programmable grid interface, and specific Template designs are and will remain the exclusive property of AInalyz and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AInalyz makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the accuracy of the insights generated.

The analytics, transformations, and actionable insights generated by AInalyz are for informational purposes only. We do not guarantee the accuracy, completeness, or usefulness of any data output. You rely on these insights at your own risk.

7. Limitation of Liability

In no event shall AInalyz, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, revenue, data, use, goodwill, or other intangible losses.
• Business or financial decisions made based on the actionable insights or data outputs generated by the Service.

Under no circumstances will AInalyz's total liability to you for all damages, losses, and causes of action exceed the amount you have paid AInalyz in the last six (6) months, or one hundred dollars ($100), whichever is greater.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
